After last year ' s decision by a federal appeals court, the only issue under consideration by the Court of Federal Claims was whether the FAA violated the applicable federal statutes when it allowed e mployees to accumulate credit hours in excess of twenty - four while working a flexible schedule. In today ' s decision, the court held that the accumulation of credit hours above the twenty - four hours cap was a violation of law and that the affected plaintif fs in the case are entitled to time - and - half overtime pay for those excess credit hours. The court also held that the affected plaintiffs are entitled to liquidated damages in an amount equal to the amount of the time - and - a - half overtime award. The court h as requested that the parties submit their filings on damages in early January. Counsel for NATCA is reviewing the decision and will issue a more detailed analysis soon . LABOR RELATIONS DEPARTMENT NATCA PARTICIPATE S IN NTSB INVESTIGATION AT AKRON/CANTON (CAK) On November 16 and 17, 2015, NATCA participated in an NTSB inves tigation at Akron/Canton ATCT. The NTSB came to the facility to investigate a fatal accident involving (Zipline) EFT1526/H25B that had occurred o n November 10, 2015, approximately two miles northeast of the nearby satellite airport of Akron/Fulton (AKR). The CAK ATCT provides air traffic control services to pilots on their way t o the non - towered AKR airport. The NTSB's ATC workgroup included Lead I nvestigator Betty Koschig, FAA SME Ross "Barry" Knolls, and NAT CA ASI Representative Tim Keck. The
