UPDATE ON FLSA SUIT
The Department of Justice (DOJ) filed a new motion on Aug. 21 asking for a 10 - day
extension to review and finalize the damages calculations. The Court approved the
DOJ's request for an extension of time. Pursuant to the C ourt's order, the submission on
damages is due on Aug. 31.
Background : In its March 31, 2017 decision in this case, the U.S. Court of Federal
Claims directed the parties to file a joint stipulation by July 30 of the individual damages
due to each of the N ATCA plaintiffs. At the last minute, the Department of Justice
requested a two - week extension of this deadline. The Court granted the extension with
the caveat that any further requests for extensions would not be granted absent a
showing of extraordinary circumstances. The Department of Justice had begun working
with counsel representing the NATCA plaintiffs on compilation of a final list of damages,
and NATCA anticipated that the parties would meet the Court's new deadline of Aug. 14,
2017 for the damages submission.
However, we learned on Aug. 14, 2017 that the Court granted another one - week
extension for the submission of the stipulation on damages because the expert assisting
with the calcu lations was unavailable .
