NATCA PREVAILS IN ARBITRATION ON RIGHTS OF UNION REPRESENTATIVES
TO ENGAGE IN PROTECTED ACTI VITY
On Nov . 6, 2017, NATCA received an arbitration award in a grievance from Region X
concerning the ri ghts of union representatives. The Agency had imposed a five - day
suspension on a union representative for an incident in which the union representative
entered a manager ' s office and placed an information request on the manager ' s desk
despite having been told to leave the request wit h an administrative assistant. In
suspending the union representative for five days, the Agency charged him with
disruptive behavior, failure to follow instructions, and disrespectful behavior.
The Arbitrator held that the union representative was acting in his capacity as a union
representative, and that the representative's conduct was not flagrant misc onduct and
did not otherwise exceed the boundarie s of protected union activity. The Age ncy was
ordered to rescind the five - day suspension and make the union representative whole for
all lost wages.
