2 ARTICLE 1 PARTIES TO THE AGREEMENT Section 1. The authorized represent atives of the Department of Defense, National Guard Bureau, Army National Guard Readiness Center, Aviation and Safety Division, Aviation Operations and Training Branch, Los Alamitos, California, (hereinafter referred to as the "Agency" or the "Employer"), and the National Air Traffic Controllers Association, AFL - CIO (hereinafter referred to as "NATCA" or "the Union"), collectively known as "the Parties," agree to the following Collective Bargaining Agreement (CBA or "Agreement" ) in order to fulfill their re spective obligations pursuant to the Federal Service Labor - Management Relations Statute, 5 United States Code (U.S.C.) 7101 et seq., ("the Statute"). These agreed upon procedures shall pertain to all Bargaining Unit Employees (BUE) who are assigned to the National Guard Bureau, Army National Guard Readiness Center, Aviation and Safety Division, Aviation Operations and Training Branch, Los Alamitos Air Traffic Control Tower, Los Alamitos, California. Section 2. The bargaining unit consists of all non - superv isory Title 5 Air Traffic Control Specialists (ATCs) of the National Guard Bureau, Army National Guard Readiness Center, Aviation and Safety Division, Aviation Operations and Training Branch, Los Alamitos Air Traffic Control Tower (SLI), Los Alamitos, Cali fornia as certified by the FLRA on August 11, 2009, Case No. SF - RP - 09 - 0029 (Appendix 1). If the Unit is modified by the FLRA, this Agreement shall apply to the Unit as modified, in accordance with applicable law, rule, and regulation. Section 3. No modi fication or waiver of the legal terms and conditions of this Agreement shall be valid unless made in writing and executed by the Parties. ARTICLE 2 OFFICIAL TIME Section 1. The Union Facility Representative (FACREP) designated in this Article shall be g ranted a reasonable and necessary amount of official time, if otherwise in a duty status, for purposes provided for by this Agreement. Section 2. The FACREP will submit a request to their immediate supervisor or Air Traffic Control Facility Chief (ATCFC) to use official time.
