LABOR RELATIONS DEPARTMENT NATCA MEETS WITH THE AGENCY TO DEVELOP AN IMPLEMENTATION PLAN FOR THE OSH REPRISAL ORDER On March 31, 2016, NATCA met with the FAA to discuss the implementation plan for F AA Order 3770.14, FAA Procedures for Responding to Allegations of Occupational Safe ty and Health (OSH) Reprisals. Order 3770.14 establishes new procedures to ensure that no employee is subject to restraint, interference, coercion, discrimination or reprisal for filing a report of an unsafe or unhealthy working condition, or other participation in agency occupational s afety and health program activities, in compliance with Executive Order 12196. It was initially developed by a joint labor/management workgroup. During the meeting, the Parties developed the eLMS training to educate all FAA employees and managers on the c ontents of the Order. The training is designed to ensure that employees understand their OSH rights and feel free to exercise them without fear of reprisal. It emphasizes that the purpose of the training is to ensure that reprisal allegations reported unde r the Order will be investigated and resolved in a consistent and uniform manner and that managers will be held accountable for maintaining the FAA's culture of safety. NATCA RECEIVES FOLLOW - UP BRIEFING ON HRPM SUPPLEMENT ER - 4.1A: USE OF SOCIAL MEDIA BY FAA EMPLOYEES On October 5, 2015, NATCA received notice that the Agency was implementing Human Resources Policy Manual (HRPM), Volume #4: Employee Relations, Poli cy Chapter Supplement ER - 4.1a. The Agency stated that the policy was a supplement to ER - 4.1a Standards of Conduct and provides guidance to managers and emp loyees on social media conduct. NATCA requested a full briefing on the matter, whic h was held on October 28, 2015. Following that briefing, NATCA's representatives submitted a proposal that revised the policy in order to alleviate its concerns about the broad language and unclear gu idance provided by the policy. FAA representatives agreed to revise the policy based on NATCA's proposal and then send NATCA a copy of the revised policy before implementing it. NATCA received the revised pol icy on Friday, March 25, 2016. Despite purporting to have revised the p olicy to address NATCA's concerns, the FAA's revised policy continued to be problematic for NATCA BUEs. Thereafter, the parties held a follow - up briefing to discuss the revised policy. As a result of the follow - up briefing, NATCA proposed to send the Agenc y another redline of the policy addressing NATCA's remaining concerns, and the Agency agreed to attempt to again address these concerns. BRIEFING REQUESTS On April 5, 2016, NATCA requested a briefing on the Part 21 Rulemaking Workgroup. We are currently waiting for a response from the Agency regarding our request.
