On Aug . 27th, NATCA attended an arbitration hearing before Arbitrator Linda Byars, regarding the indefinite s uspension of a long - tenured Civil Engineer fo r alleged off - duty misconduct. The parties will submit legal briefs in this expedited arbitration case by Sept . 4th. PERSONALLY IDENTIFIABLE INFORMATION (PII) On Aug . 27, 2015, NATCA filed a national grievance regarding Personally Identifiable Information (PII). On Aug . 14, 2015, NATCA became aware that the Agency had c ompromised the Personally Identifiable Information (PII) of a NATCA bargaining unit employee. The FAA notified NATCA of this violati on via email. Article 66, Section 7 of the CBA provides, "All correspondence between the Flight Surgeon's Office and the emp loyee is confidential." FAA Order 1280.1B requires that employees sending PII via email use encryption to do so. It states, "If sending an imaged document by email within the FAA email domain, use the email system's... encryption op tion to protect the do cument." The Agency's disclosure of the BUE's private and confidential medical information, which included PII, directly violated Article 66, Section 7 of the CBA; the Privacy Act of 1974; and other applicable laws, rules, regulations, and past practice. N ATCA requested in its grievance that the Agency immediately cease and desist from violating the CBA, the Privacy Act of 1974, and all other applicable laws, rules, regulations, and past practice.
