NATCA NATIONAL OFFICE
DEPARTMENTAL WEEK IN REVIEW
August 5 - 11 , 2017
OFFICE OF NATCA GENERAL COUNSEL
UPDATE ON FLSA SUIT
In its March 31, 2017 decision in this case, the U.S. Court of Federal Claims directed the
parties to file a joint stipulation by Jul y 30 of the individual damages due to each of the
NATCA plaintiffs. At the last minute, the Department of Justice requested a two - week
extension of this deadline. The Court granted the extension with the caveat that any
further requests for extensions woul d not be granted absent a showing of extraordinary
circumstances. The Department of Justice ha d begun working with counsel representing
the NATCA plaintiffs on compilation of a final list of damages, and NATCA anticipate d
that the parties would meet the Co urt's new deadline of Aug. 14, 2017 for the damages
submission.
However, we learned on Aug. 15, 2017 that the Court has granted another one - week
extension for the submission of the stipulation on damages because the expert assisting
with the calculations was unavailable over the past week. The calculations should be
finalized this week, and the Court has issued a new deadline of Aug. 21, 2017 for the
submission.
NATCA will provide additional information once that submission has been made. Any
questions a bout the status of the case should be directed to NATCA General Counsel
Marguerite L. Graf ( mgraf@natcadc.org ).
