LABOR RELATIONS DEPARTMENT NATCA RECEIVES BRIEFING REGARDING REVISED FEDERAL INVESTIGATIVE STANDARDS (FIS) On June 7, 2016, NATCA received a briefing regarding the Revised FIS drafted by an inter - agency working group pursuant to Executive Order 13467, Reforming Processes Related to Suitability for Government Employment, Fitness for Contractor Employees, and Eligibility for Access to Classified National Security Information. Under these Guidelines, NATCA BUEs occupying Moderate Ri sk positions will be subject to suitability reinvestigations every five years. NATCA BUEs occupying Non - critical, Sensitive positions will be subject to security clearance rein vestigations every five years. The FAA will soon begin to phase in the Revised F IS, starting with investigations of those employees who have gone the longest without reinvestigation. NATCA BUEs who are contacted by an OPM investigator outside of work hours have the right to schedule an investigatory interview on du ty time, and at you r facility. Should an OPM investigator contact you outside of work, please refer him or her to your facility management in order to schedule the interview at work. NATCA BUEs should also request NATCA representation for all suitability (i.e. no security c learance involved) reinvestigation interviews by OPM, as in accordance with settled law the OPM must allow you Union representation at suitability investigation interviews. For security clearance reinvestigations by OPM, the law is unsettled. However, NATC A encourages you to always request Union representation for any investigatory interview. AGENCY BRIEFING ON FAA ORDER 1800.6C On May 18, 2016, the Agency notified NATCA about its intention to update FAA Order 1800.6C on Unsatisfa ctory Condition Reports (UCR). On June 9, 2016, the Agency briefed NATCA about this update, which was required to bring it into compliance with Occupational Safety and Health (OSHA). Substantive changes to the Order include record retention for five years (OSHA compliance), and the timefra me for taking act ion under UCR (OSH timeline) – 24 hours for an imminent danger, three working days for a potentially serious condition, and 20 working days for other than serious. The Order also eliminates the requirement of a minimum of two levels of rev iew before officially closing a UCR. At this time, NATCA is still looking into whether we have any proposals. AGENCY BRIEFING ON PERTI On May 20, 2016, the Agency notified NATCA about its intention to make changes to the FAA TFM PERTI (Planning, Execution, Review, Training, and Improvement) initiative. On June 7, 2016, that briefing was held at NATC A. The FAA is in very early stages of developing the concept of how to better analyze and learn from predictable events. PERTI is a NAS - wide ATO initiative. The goal is to improve planning to mitigate effects, develop metrics and tools, and use the informa tion gained through the review process to customize training on the process and systems.
